In certain situations, music is used as an accompaniment, oftentimes simply a set of sounds designed to subconsciously affect the listener. While in other situations, music is the central point, dominating the dialogue yet continuing to subconsciously affect the listener. Law, on a similar note, is a concept that is inescapable. Legal scholars have noted for centuries that society in the United States evolved, and continues to evolve, toward a population dependent on law. Both music and law remain fundamental components of modern American life and there are no signs that our connection and reliance on music and law will change in the future. This book addresses the role music plays in constituting law in the United States. The subject of the book is important in order to show that while the Supreme Court writes decisions and legislators create and modify statutes, music is more invasive and influential in the lives of the populous. The book s first purpose is to introduce readers to the classic jurisprudential schools of thought and connect those philosophies to the lyrics of various songs. There is clear evidence that Natural Law and Legal Positivism have been instrumental in establishing a legal structure and philosophy of law. The remnants of those jurisprudential schools can be directly seen in the lyrics of the last 50 years. The book notes that greater attention should be paid to the music since it is in actuality, non-traditional jurisprudence. After classic jurisprudence is presented, the book undertakes Constitutive Theory and connects lyrics to this critical approach of law. The book s second objective is to systematically explain the role that music plays in constituting images of Race, Gender, and Class. Legal scholars have argued that music and law are often loosely connected but this book asserts that music creates law and images of law through specific lenses. Critical Race Theory, Feminist Legal Theory, and underclass literature are the best examples of how music has explicitly infected legal circles. The book highlights the impact that musicians have in constituting law through their lyrics. When musicians remind the listener of the injustices in society, call for social change, or give their interpretation of legal theory, an image of law is constituted and that image often becomes the Law. When musicians create music, they are simultaneously creating law. Their experiences, language, and motives encompass their being and develop an image of law, which the listener subsequently adopts. Their lyrics constitute what law is for the people which is often a direct response to the State s version of what law is or should be. Music is similar to or a reaction to law. |

Even if there is little new ground broken, the presentation is exceptional — Dre never sounds better as a producer than when Eminem pushes him forward (witness the stunning oddity “Square Dance,” a left-field classic with an ominous waltz beat) and, with three albums under his belt, Eminem has proven himself to be one of the all-time classic MCs, surprising as much with his delivery as with what he says. Plus, the undercurrent of political anger — not just attacking Lynne Cheney, but raising questions about the Bush administration — gives depth to his typical topics, adding a new, spirited dimension to his shock tactics as notable as the deep sentimental streak he reveals on his odes to his daughter. Perhaps the album runs a little too long at 20 songs and 80 minutes and would have flowed better if trimmed by 25 minutes, but that’s a typical complaint about modern hip-hop records. Language $15.99 Over her mere seven-album discography, Lorraine Feather has carved out a fulfilling career as a jazz singer far outdistancing many one-shots, far less talented but successful pop-jazz vocalists, and wannabes. Her talent as a lyricist of wit, sarcasm, and keen observations of the American human condition is her true strength, and not always as acknowledged as her verbal chops and inventiveness. Her language goes beyond the nomenclatures of swing, bop, and contemporary improvisation, as Feather exploits many literary references and well-worn phraseology from various acumens, and keeps the proceedings upbeat and interactive between her words and the musical notes offered by her excellent confreres. Pianist Shelly Berg is closest to Feather as a collaborator, writing the music for Feather’s cleverest lyrics. The quick, lithe, bouncy, and brisk “Traffic and Weather” relates to Bay Area commuter congestion, climatological issues, or references to inseparable pairings, and “We Appreciate Your Patience,” with a cynical, animated take on annoying automated answering services, teams Feather and Berg in multilevel harmonic and whimsical refrains. Feather is fond of stringing worn-out clichés together, as on “Patience,” but is in an especially sharp mood about trite multiple sports adages on the bopper “Hit the Ground Runnin’,” featuring a furious Russell Ferrante on piano, and tells the all too familiar thoughts-racing, mouse-on-a-treadmill tale of “Where Are My Keys?,” turning a dilemma into fun. Also skillful, aside from their lyric content, are her instrumental ideas, like using a horn section and a drummer only on the sassy tale of a career dilemma “Waiting Tables,” or the slinky, bluesy Duke Ellington-like “A Household Name,” debunking stardom and alerting you to the pitfalls of the celebrity trap. Feather can also be sentimental, as on her romanticized Billy Strayhorn waltz tribute “In Flower,” the melancholy “I Love New York at Christmas,” and her most languid, evocative tune, “Making It Up as We Go Along.” She is rarely self-conscious or insular, but Ferrante’s modal two-chord piano prop-up during “Home Alone” keeps Feather’s possible dour mood in check, although she can’t help being doting on “Very Unbecoming.” On occasion, vocalists Tierney Sutton, Janis Siegel, and Cheryl Bentyne enter in supportive vocal cameos. This may very well be Lorraine Feather’s best effort, certainly the one where collaboration is the key, and statements on our disposable, technology-driven, time-consuming society had to be made.
